E.J.K. is Ms. Calgaro’s transgender daughter. E.J.K. was forced to leave home at fifteen-years old because she was being physically and emotionally mistreated by her mother and step-father. While living on her own, E.J.K. sought mental health, and eventually medical, treatment for her gender dysphoria. When Ms. Calgaro found out that E.J.K. began accessing transition-related care, she sued St. Louis County for providing E.J.K. with medicaid benefits and E.J.K.’s medical providers for providing E.J.K. with medically necessary treatments. She also sued E.J.K.’s school district because the district did not provide her with E.J.K.’s school records. Ms. Calgaro claimed that each of the defendants interfered with her constitutional right to parent E.J.K. She sought monetary damages and an injunction prohibiting E.J.K. from obtaining further transition-related care and preventing her providers from given her that care.

The National Center for Lesbian Rights and Faegre Baker Daniels LLP represented E.J.K. and immediately moved to dismiss Ms. Calgaro’s complaint on December 15, 2016. On May 23, 2017, the District Court concluded that none of the defendants’ conduct interfered with Ms. Calgaro’s right to parent E.J.K. Ms. Calgaro appealed the dismissal of her complaint to the Court of Appeals for the Eighth Circuit. On March 25, 2019, the Court of Appeals for the Eighth Circuit affirmed the dismissal of Ms. Calgaro’s claims. Then, on October 7, 2019, the United States Supreme Court denied Ms. Calgaro’s petition for certiorari.
